Legal obligations

Definition of Manufacturer / Importer:

Shall mean any natural or legal person who, regardless to the selling technique used, places on the market for the first time the batteries or accumulators, including batteries or accumulators build in devices or vehicles, in the framework of a professional activity.

Statutory duties:

Under the sections 31 and 32 of the Spanish Law on waste and contaminated soils (Ley 22/2011, de 28 de julio, de Residuos y Suelos contaminados), and under the abovementioned Real Decreto 106/2008, every manufacturer shall be bound to the collection and disposal of the same quantity – by weight and type – of spent electrical storage units, accumulators, and batteries that he has placed on the market, regardless to his selling method, either when this one has been direct, electronic, by mail or automatic. Thus he shall be responsible for:

  • Collecting and handling the waste at the end of the product life cycle.
  • Funding the management of the collection and recycling systems.
  • Applying for the region’s (comunidad autónoma) approval and entering his product in the REI-RAEE register of the Spanish Ministry of Industry
  • Ensuring the achievement of the collection targets by weight.

    For the waste portable batteries and accumulators, the following minimum  collection rates shall be achieved:

    - 25% As of 31 December 2011
    - 45% As of 31 December 2015

    By 2010: collection target of 90% by weight of the automotive batteries sold during the year preceding the collection.

    By 2010: collection target of 90% by weight of the automotive batteries sold during the year preceding the collection.

    By 2010: collection target of 95% by weight of the batteries, accumulators and industrial batteries containing cadmium sold during the year preceding the collection.

    The recycling procedures shall achieve the following minimum efficiency standards for recycling:

    - Recycling of 65% by weight, of lead-acid batteries and accumulators.
    - Recycling of 75% by weight, of Ni-Cd batteries and accumulators.
